الإختفاء القسري: تصديق لبنان على الإتفاقية الدولية حاجة ملحة!
تدخل الإتفاقية الدولية لحماية جميع الأشخاص من الاختفاء القسري حيّز التنفيذ في 23 كانون الأول/ديسمبر 2010. فمنذ أوائل الثمانينيات، يناضل أهالي ضحايا الاختفاء القسري والجمعيات المعنية لإيجاد سند قانوني على المستوى الدولي يسمح بمناهضة هذه الجرائم.
في العام 2006، إعتمدت الجمعية العامة للأمم المتحدة هذه الإتفاقية ودعت الدول للتوقيع في العام 2007. وقد شكل هذا الأمر إنتصاراً مهمّاً لعائلات المفقودين وللمنظمات غير الحكومية التي تدعم حقوق الإنسان. وستدخل هذه الإتفافية حيّز التنفيذ غداً ، 23 كانون الأول/ديسمبر، بفضل تصديق الحكومة العراقية عليها.
ان هذه الإتفاقية تكرس عدداً من الحقوق للضحايا، فهي تضمن الحق في حماية الأشخاص من الإختفاء القسري وحق عائلات المفقودين بمعرفة الحقيقة. كما تشكل خطوة إلى الأمام في محاربة الإفلات من العقاب. إضافة إلى ذلك، فانها تنص على فرض عقوبات على الدول التي تشارك في مثل هذه الجرائم. كما تنص على إنشاء لجنة تُعنى بجرائم الإختفاء القسري وتتكفل بمراقبة تنفيذ هذه الإتفاقية والحماية من الإختفاء القسري على المستوى الدولي.
ونشير إلى أن لبنان قد وقّع في باريس على هذه الإتفاقية في شهر شباط /فبراير 2007. واعتبرت الحكومة الحالية أن التصديق عليها هدفاً مهماً، وأدرجته في بيان سياستها العامة. ومع ذلك، لم يجر التصديق عليها حتى تاريخه بالرغم من المطالبات المتكررة لجمعيات أهالي الضحايا والمنظمات غير الحكومية في هذا المجال، علماً أن لبنان معني مباشرة بحالات الإختفاء القسري إذ لا يزال 17000 شخص في عداد المفقودين حتى اليوم وينتظر أقرباؤهم منذ فترة طويلة أن تقوم دولتهم بأي مبادرة ملموسة بدلاً من تقديم الوعود الكاذبة. الأمر الذي يدفعنا إلى التساؤل اليوم عن الأسباب التي حالت وتحول دون المصادقة على هذه الإتفاقية، ومن الصعوبة بمكان التصديق بأن ذلك هو نتيجة إهمال وحسب!!!
ان هذه الإتفاقية تعدّ رسالة أمل بالنسبة لجميع عائلات المفقودين في لبنان الذي ينتظرون معرفة الحقيقة. وبالتالي، فإنه من الضروري جداً أن يقوم لبنان بالتصديق على هذه الاتفاقية، وأن يلتزم بشكل صارم بمكافحة ممارسات الإختفاء القسري. عندها تستقيم علاقة اللبنانيين بدولتهم بعد أن تثبت مصداقيتها بتنفيذ ما التزمت به، وتستعيد ثقة المجتمع الدولي بها.
نحن، جمعيات أهالي المفقودين والمنظمات المعنية في موضوع حالات الإختفاء القسري ، نحث بشكل ملح كلاً من رئيس الجمهورية ، رئيس مجلس النواب ورئيس مجلس الوزراء على احترام ما ورد في البيان الوزاري تجاه قضيتنا، واتخاذ ما يلزم بشكل فوري للتصديق على الإتفاقية الدولية لحماية جميع الأشخاص من الاختفاء القسري.
وضمن هذا الإطار ذات الطابع الدولي، ندعو قاضي الأمور المستعجلة في بيروت لمتابعة قراراته الجريئة المتعلقة بالدعويين بشأن المقبرتين الجماعيتين في مار متر وحرج بيروت، ونربأ به استكمال الإجراءات إلى خواتيمها تكريساً لحق المعرفة.
كما ندعو محكمة جنايات الجنوب/صيدا إلى بت الدعوى المتصلة باختطاف المربي محيي الدين حشيشو والتي ما تزال عالقة منذ أكثر من عشر سنوات.

Enforced disappearance: It is urgent for Lebanon to ratify the International Convention!
On 23 December 2010, the International Convention for the Protection of All Persons from Enforced Disappearance will enter into force. Since the early 80’s, victims and associations have been struggling to create an international legal instrument to prevent enforced disappearances. Adopted in 2006 by the United Nations General Assembly and opened for signature in 2007, the Convention is therefore considered an important victory for the relatives of the disappeared persons and the Human Rights NGOs supporting them. This convention will partly enter into force due to the ratification of the Iraqi Government on 23 November.
The Convention grants several rights to the victims of enforced disappearances as it guarantees the right for a person not to be subjected to enforced disappearance and the right for the families of disappeared persons to know the truth. It also constitutes a step forward in the fight against impunity. In addition, the text stipulates requirements for the states, which include, among others, the international cooperation. The Convention also stipulates the sanctions to which the states involved in enforced disappearances shall be exposed. Finally, the text states the establishment of an International Committee against Enforced Disappearances, which monitors the implementation of the Convention and protect against enforced disappearances on an international level.
Lebanon signed this Convention in February 2007 in Paris, and the current government has considered its ratification to be an important objective by including it in its Ministerial Declaration. However, Lebanon is yet to ratify this Convention, despite the numerous calls of the victims and NGOs. Lebanon is directly affected by the enforced disappearances, as 17,000 Lebanese persons are still missing to date. Relatives of the disappeared persons have been waiting for too long for their state to take serious actions instead of making promises. We question the reasons which prevent this ratification and, we find it hard to believe that this is the result of mere negligence!!!
For the thousands of relatives of the disappeared persons waiting to know the truth, this Convention is a message of hope. It is therefore necessary and urgent for Lebanon to ratify the text and be strictly committed to fight against practices of enforced disappearances.
This ratification will send a powerful message of hope to the Lebanese people and enhance the transferability of the Lebanese state not only vis-a-vis its citizens but also vis-a-vis the International Community.
We, the families of the disappeared persons and organizations working in this field, urge the President of the Republic, the Speaker of Parliament and the Prime Minister to respect the Ministerial Declaration and ratify the International Convention for the Protection of All Persons from Enforced Disappearance as soon as possible.
In this international framework, we call on the urgent applications judge of Beirut to continue his courageous decisions with regard to the two complaints concerning the “Mar Mitr” and “Herech Beirut” mass graves, and encourage him to continue these steps in order to confirm the right to know.
Similarly, we call on the Criminal Court of South Lebanon [Saida] to deal without delay with the case concerning the disappearance of Mr. Hachichou, this complaint has been ongoing for over 10 years.

Disparitions forcées : Il est urgent que le Liban ratifie la Convention internationale !
Le 23 décembre 2010, la Convention internationale pour la protection de toutes les victimes contre les disparitions forcées entrera en vigueur. Depuis le début des années 80, victimes et associations luttent pour la création d’un instrument juridique au niveau international permettant de lutter contrer les disparitions forcées et de les prévenir. Adoptée en 2006 par l’Assemblée Générale des Nations Unies et ouverte à la signature en 2007, la Convention constitue donc une victoire importante pour les proches de disparus et les ONGs de droits de l’Homme les soutenant. C’est en partie grâce a la ratification de la convention par le gouvernement irakien le 23 novembre que cette convention est entrée en vigueur.
La Convention consacre plusieurs droits pour les victimes de disparations forcées. Elle garantit le droit à ne pas être soumis à la disparition forcée et le droit a la vérité pour les familles des personnes disparues. Elle constitue de même un pas en avant dans la lutte contre l’impunité. Le texte institue aussi des obligations pour les Etats parmi lesquelles figurent la coopération internationale. En outre, la Convention fait mention de sanction auxquelles s’exposent les Etats impliqués dans la pratique des disparitions forcées. Enfin, le texte institue un comite sur les disparitions forcées qui aura pour mandat de suivre l’application de la convention et la protection contre les disparitions forcées au niveau international.
Le Liban a signé cette convention en février 2007 à Paris, et le gouvernement actuel a considéré la ratification comme un objectif important en l’incluant dans sa déclaration de politique générale. Pourtant, l’Etat libanais n’a toujours pas ratifie la Convention malgré de nombreux appels en ce sens issus des victimes et des ONG. Or, le Liban est directement concerne par les disparitions forcées. 17000 personnes libanaises sont à ce jour portées disparues. Les proches de disparus libanais attendent depuis trop longtemps que leur Etat agisse, qu’il daigne leur offrir autre chose que des promesses. Nous nous interrogeons sérieusement sur les raisons qui empêchent cette ratification, nous avons du mal a croire que ceci est le fruit de la simple négligence !!!
Pour les milliers de proches de disparus au Liban qui attendent la Verite, la Convention est un message d’espoir. Il est donc nécessaire et urgent que le Liban ratifie ce texte et s’engage ainsi fermement dans lutte visant à mettre fin à la pratique des disparitions forcées. Une ratification enverrait un message d’espoir fort aux Libanais et renforcerait la cessibilité de l’Etat libanais vis-à-vis de ces citoyens mais aussi vis-à-vis de la communauté internationale.
Nous, familles de disparus et organisations travaillant sur le sujet demandons instamment au Président de la République, au Président du Parlement et au Premier ministre de respecter la déclaration ministérielle et de ratifier dans les plus brefs délais la Convention internationale pour la protection de toutes les personnes contre les disparitions forcées.
Dans ce cadre internationale, nous appelons le juge des référés de Beyrouth de poursuivre ces décisions courageuses concernant les deux plaintes relatives aux fosses communes de « Mar Mitr » et de « herech Beyrouth » et l’incitons a poursuivre ces demarches afin de confirmer le droit de savoir.
De même nous appelons la cour pénale du Liban sud [Saida] a traiter sans retard l’affaire concernant la disparitions de M. Hachichou, cette plainte est en cours depuis plus de 10 ans.
